Terms of Service

1. Your agreement with Instacoach LLC

These Terms of Service ("Terms") govern your use of GoRoam at https://goroam.ai, its associated applications, and related services (the "Services"). The Services are operated from San Francisco, California, by Instacoach LLC ("Instacoach," "we," "us," or "our"). GoRoam is our product name.

By clicking an acceptance button or otherwise affirmatively agreeing to these Terms, you enter into an agreement with Instacoach LLC. If you do not agree, do not create an account or use features that require acceptance. Our Privacy Policy explains how we handle personal information; accepting these Terms does not replace consent separately required under privacy law.

2. Eligibility and your account

You must be at least 18 years old and legally able to enter into this agreement. If you act for someone else, you must have authority to provide their information and make the requested arrangements.

You may sign in using Google, Apple, or an email address and password. Provide accurate account and booking information, protect your login credentials, and promptly notify us of suspected unauthorized access. You are responsible for activity you authorize through your account. You are not automatically responsible for unauthorized activity caused by our failure to meet applicable obligations.

3. What GoRoam provides

GoRoam helps you discover restaurants and attractions, organize itineraries, obtain AI-assisted travel suggestions, and access available reservation or ticketing features. GoRoam is available to users internationally. Features, supported destinations, and Provider availability may vary by location and may change. Access remains subject to applicable law.

Restaurants, attractions, ticket sellers, and other independent providers ("Providers") generally supply the underlying experiences. GoRoam's role may include displaying information, referring you to a Provider, or transmitting a reservation request you approve. The reservation flow will identify the Provider and any additional terms that apply. GoRoam V1 does not collect or process payments.

We remain responsible for our own Services and any obligations imposed on us by applicable law. Nothing in these Terms changes our legal status merely by describing us as a technology platform.

4. Recommendations, AI, and travel decisions

AI-generated recommendations and third-party information can be incomplete, inaccurate, or outdated. Availability, prices, opening hours, routes, estimated travel times, reviews, accessibility information, and entry requirements may change. A recommendation or itinerary is not a confirmed booking.

Before relying on a material detail, check the booking confirmation or verify it with the Provider. Confirm allergies and dietary needs directly with the restaurant, and confirm accessibility arrangements directly with the venue. GoRoam cannot guarantee an allergen-free meal, a particular experience, or the safety of a destination or route.

Use your judgment, observe local rules and posted instructions, and allow time for travel and admission. GoRoam is not an emergency service. Contact local emergency services for urgent assistance. These provisions do not excuse misleading statements or duties we cannot lawfully exclude.

5. Reservations, purchases, and your authorization

Before submitting a booking, review the date, local time and time zone, party size, traveler names, ticket categories, price, currency, and cancellation terms. You authorize us to transmit a reservation request only when you approve the specific action presented in the Services. This does not authorize GoRoam to make a payment.

Asking for suggestions or saving an itinerary does not authorize a reservation. We will seek further approval for a material change to the reservation details outside the scope of your authorization.

A request is not confirmed until a confirmation is issued by the Provider or by GoRoam on the Provider's behalf. Check that the confirmation matches your request and contact support promptly if it does not. Do not assume a failed screen means a reservation request failed; verify its status before trying again to avoid duplicate reservations.

Providers may impose age limits, identification requirements, arrival deadlines, dress codes, ticket-transfer limits, or other conditions disclosed in the booking flow. You must comply with the conditions applicable to your booking.

6. No payments in V1

GoRoam V1 does not offer payment functionality and does not collect or process payments for reservations, tickets, or other experiences. These Terms do not authorize GoRoam to charge you or create a paid subscription.

Any prices displayed are informational and may change. If an experience requires payment, any purchase must be completed separately with the Provider or another third-party service. Review that party's final price, currency, taxes, fees, and payment terms before making a purchase. GoRoam does not complete that payment on your behalf.

If GoRoam introduces payment functionality in the future, we will provide the applicable pricing and payment terms and obtain any required acceptance before you use it.

7. Cancellations, changes, refunds, and no-shows

Provider-specific cancellation and change terms apply to reservations. If you separately purchase a ticket or agree to a deposit, card guarantee, or no-show charge directly with a Provider, its disclosed terms and applicable law govern those arrangements. GoRoam V1 does not take deposits, hold payment cards, or collect cancellation or no-show charges.

Use the cancellation method shown in your confirmation. Sending a chat message requesting cancellation does not establish that the Provider accepted it; look for a cancellation confirmation. We will communicate the result of requests we handle. This does not limit your rights if we fail to process a request we agreed to handle.

If a Provider cancels or materially changes an experience, the applicable Provider terms and mandatory law govern available refunds or alternatives. We will provide reasonable assistance for bookings made through GoRoam. For payments you make separately to a Provider or third-party service, contact that party about refunds. GoRoam V1 does not process those payments or refunds.

Deleting your account or removing an itinerary does not cancel a reservation. Nothing in these Terms limits a refund or other remedy required by law or excuses GoRoam from responsibility for its own errors.

8. Provider relationships and third-party services

Provider terms govern their underlying experiences, including admission and conduct rules. These Terms govern your relationship with Instacoach LLC. We do not control independent Providers, and their websites and services may have separate privacy policies and terms.

Some links generated or displayed by GoRoam may be affiliate links. If you complete an eligible booking through one of these links, we may receive a commission from the Provider or referral partner. We will identify paid placements and disclose material commercial relationships where required. A commission does not mean that GoRoam processes your payment, and a commercial relationship does not guarantee that an option is suitable for you.

9. Acceptable use

You may use GoRoam for lawful personal travel planning and authorized bookings. You may not:

  • Make fraudulent, speculative, or unauthorized reservations.
  • Impersonate another person or submit information you have no right to share.
  • Harass others or submit unlawful or infringing content.
  • Bypass security, gain unauthorized access, distribute malicious software, or interfere with the Services.
  • Scrape or extract data at scale without permission, except where applicable law permits it.
  • Resell or exploit access to the Services commercially without our written permission.

10. Your content and our intellectual property

You retain your rights in the content you submit. You grant Instacoach LLC a nonexclusive, worldwide, royalty-free license to host, store, reproduce, process, and transmit that content only as reasonably necessary to provide, secure, and maintain the Services and carry out your instructions. The license continues only for those purposes and applicable retention obligations. It does not authorize unrelated marketing use of private trip information or override the Privacy Policy.

If you choose to publish a review or share an itinerary, the chosen audience can view the included content. Do not submit content that violates another person's rights. We may remove content that violates these Terms or applicable law.

GoRoam software, branding, and interface elements belong to Instacoach LLC or its licensors. Subject to these Terms, we grant you a limited, nonexclusive, nontransferable right to use the Services for their intended purpose. You may use generated itineraries for personal travel, but AI output may not be unique or protectable, and third-party content remains subject to its owner's rights.

11. Communications

We may send account, security, booking, and service communications through the channels you provide or enable. Marketing communications are subject to applicable consent requirements and opt-out controls. Agreement to these Terms alone does not constitute consent to promotional text messages or automated marketing calls.

12. Availability, suspension, and termination

We may update, temporarily interrupt, or discontinue features. We will provide reasonable notice of material changes when practicable and take reasonable steps to address outstanding obligations for bookings we have agreed to support.

We may restrict or suspend access where reasonably necessary to address fraud, security threats, unlawful activity, or a material breach of these Terms. Where practicable and legally permitted, we will explain the reason and provide a way to contact us about the decision.

You may stop using GoRoam and request account deletion through admin@goroam.ai. Termination does not automatically cancel Provider bookings or remove obligations you separately agreed to with a Provider. Provisions intended to survive, including accrued obligations and dispute provisions, continue as applicable.

13. Disclaimers

To the fullest extent permitted by law, the Services are provided "as is" and "as available," without warranties of uninterrupted availability, error-free operation, merchantability, fitness for a particular purpose, or noninfringement. We do not guarantee Provider performance or that a suggested option will meet every preference.

These exclusions apply only where lawful. They do not exclude statutory consumer guarantees, obligations to exercise reasonable care and skill, express commitments we make, or remedies that cannot legally be excluded.

14. Limits on liability

To the fullest extent permitted by applicable law, neither party is liable to the other for indirect, incidental, special, or consequential losses arising from these Terms. This exclusion does not prevent recovery of losses that mandatory consumer law makes recoverable.

To the extent permitted by law, Instacoach LLC's total aggregate liability arising from the Services or these Terms is limited to US $100.

This limit does not reduce any refund owed to you or limit liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or any liability or statutory remedy that cannot lawfully be limited. If your jurisdiction does not permit a limitation, that limitation does not apply to you.

15. Governing law and disputes

Please first contact admin@goroam.ai so we can try to resolve your concern. This voluntary process does not prevent you from filing a claim, requesting urgent relief, or contacting a regulator, and it does not shorten any legal deadline.

These Terms are governed by the laws of California, without applying conflict-of-law rules, except that mandatory consumer protections in your place of residence continue to apply. Subject to those protections, disputes may be brought in the competent courts of San Francisco County, California. You may use small-claims court where eligible or another court available under mandatory law.

These Terms do not require arbitration or waive class-action rights.

16. Changes to these Terms

We may revise these Terms. We will update the date above and give reasonable advance notice of material changes, except where a more immediate change is reasonably needed for legal or security reasons. Where required, we will ask you to affirmatively accept the revised Terms. Changes will not retroactively alter confirmed booking terms without your agreement or as permitted by law.

17. General provisions

These Terms and any additional terms you expressly accept for a specific GoRoam feature form the agreement between you and Instacoach LLC concerning the Services. If a provision is unenforceable, the remaining provisions continue to apply. Failure to enforce a provision is not a waiver.

You may not transfer this agreement without our consent, except as allowed by law. We may transfer it in connection with a merger, reorganization, or sale of the relevant business, provided your rights under the agreement are not materially reduced. Nothing creates a partnership or employment relationship between you and Instacoach LLC.
